====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 23-04-2019 Learned counsel for the petitioner is permitted to make necessary correction in paragraph no. 1 of the bail application, in course of the day.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 11.12.2018 in a case for the offence registered under Section 379 of the IPC. Later on, Sections 395 and 412 of the I.P.C. were also added.

The prosecution story, in brief, is that on 14.10.2018 at about 6.00 P.M. in the evening, the informant was going to his shop on his Motorcycle. In the meantime, he went for natural call by standing his Motorcycle. After natural call, the informant saw that three miscreants were taking his Motorcycle. Although

Patna High Court CR. MISC. No.25009 of 2019(3) dt.23-04-2019 2/2 he tried to catch hold his motorcycle but due to fast speed, he could not catch hold his Motorcycle.

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The petitioner has not been put on T.I. Parade. Other coaccused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No.17493 of 2019, order dated 26.03.2019.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Begusarai, in connection with Muffasil P.S. Case No. 617 of 2018.
