JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Daudpur P.S. Case No. 31 of 2016 registered under Sections302/34 of the Indian Penal Code. Petitioner is named in the first information report but admittedly, the informant is not an eye witness of the alleged occurrence. Moreover, the fardbyan of the deceased was recorded in hospital and in the said fardbyan; she stated that she was caught in fire, accidentally.
Submission on behalf of petitioner is that the petitioner does not have any concern with the husband of the
Patna High Court Cr.Misc. No.37336 of 2016 (5) dt.20-12-2016 2/2 deceased and as a matter of fact, he was mediator of the marriage of the deceased and her husband and, that is the reason of his false implication in the present crime.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Daudpur P.S. Case No. 31 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
