JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2022, charge-sheet has been submitted in the case and has antecedent of five cases. Allegation is of total recovery of 16.875 litres of liquor as detailed in the F.I.R.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot rather his name transpired due to election dispute on suspicion.

Patna High Court CR. MISC. No.24926 of 2022(2) dt.20-05-2022 2/2 Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 28.02.2022, charge-sheet has been submitted in the case, he was not arrested from the spot and his name case based on suspicion, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Gopalpur (Rangra) P.S. Case No. 525 of 2021.
