No one appears on behalf of the State.
The petitioners apprehend their arrest in connection with Nawanagar P.S. Case No. 50 of 2017 registered for the offences punishable under Section 366 (A)/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that from a bare perusal of the First Information Report, it would appear that the allegation of taking away the daughter of the informant is specifically alleged against Krishna Singh. The informant himself admits in the F.I.R. that when he contacted the petitioner no. 2 who is father of Krishna Singh, he made available the mobile no. of said Krishna Singh. The informant had called Krishna Singh and there was a talk also with him. Learned counsel further
Patna High Court Cr.Misc. No.31747 of 2017 (2) dt.13-07-2017 2/2 submits that so far as these two petitioners are concerned, they have been falsely named in the First Information Report, only because they happen to be parents of said Krishna Singh. However, the petitioners are ready to co-operate with the informant and they are willing to furnish undertaking to abide by the order of this court to co-operate with the investigation. In the facts and circumstances of the case, considering the nature of allegation made against these petitioners in the FIR., let the above named petitioners, in the event of their arrest/surrender before the court below within four weeks, from today, be enlarged on bail on furnishing bail bonds in the sum of Rs.
10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Nawanagar P.S. Case No. 50 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Both the petitioners shall immediately join investigation and shall report to the Investigating Officer within a week and thereafter as and when required to conclude the investigation at the earliest.
