The petitioner seeks bail in Kanti P.S. Case No. 759 of 2020, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 750 ml. of illicit liquor has been recovered from house of this petitioner.

It is submitted that no recovery has been made from conscious possession of this petitioner. The house in question is in joint possession of family. Petitioner is in custody since 28.02.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete.

Considering the period of custody coupled with the fact that petitioner bears clean antecedent and quantity of

No.36248 of 2021(2) dt.09-12-2021 2/2 recovery, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Kanti P.S. Case No. 759 of 2020.
