JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case under Section 307 and other allied sections of the Indian Penal Code. The petitioners submit that there is a case and counter case and in fact the case filed by their side is earlier to the case filed by the informant Aman Kumar Jha. They further submit that one Smt. Deokala Devi, on their side, has sustained grievous injury. They submit that the allegations against them is of having assaulted on the hand of the informant.

In view of the submission that there is a case and counter case and the injuries caused by the petitioners are said to be on the hand of the informant, in the event of arrest or surrender

Patna High Court Cr.Misc. No.48704 of 2015 (2) dt.03-11-2015 2 / 2 before the court below within four weeks from today the above named petitioners be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Darbhanga in connection with Kusheshwar Asthan P.S. Case no. 57 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
