JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 11-08-2016 Heard the counsel for the petitioner and the State. The petitioner apprehends his arrest in G.O. Case No. 371 of 2015 registered under section 47(a) of the Excise Act.
On a raid made, 60 litres of illicit liquor kept in a plastic gallon was found. The petitioner managed to escape.
The contention of the petitioner is that he was not arrested at the spot. There is some defect in drawing the seizure memo. The petitioner is the first offender. Be that as it may, considering the allegation, in my view, the petitioner should surrender and seek regular
