2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 354, 379, 504/34 of the Indian Penal Code.

3. As per the prosecution case, this petitioner entered the house of informant, misbehaved with her and also assaulted with knife. When the husband of informant came to save her he was also assaulted by the accused persons.

4. It is submitted that petitioner has been falsely implicated in this case. Petitioner is Samadhi of informant. The informant lodged this false case only for the purpose of creating defence for the case filed by co-accused Pooja Kumari who is

Patna High Court CR. MISC. No.24652 of 2023(3) dt.13-07-2023 2/2 daughter-in-law of the informant bearing CR Case No. 76 of 2023. Moreover, the doctor has found the injury attributed to this petitioner simple in nature. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Rahika P.S. Case No. 17 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
