The petitioner, namely, Anil Sah who apprehends his arrest in Sasaram (Muffasil) P.S. Case No.821 of 2014 under Sections 420, 414 and 120(B) of the Indian Penal Code and Sections 4 and 5 of Explosive Substance Act.
The learned counsel for the petitioner submitted that the co-accused persons who were apprehended at the spot have confessed before the police wherein they have named this petitioner and other co-accused, Ramesh Choudhary and Munna Choudhary. The case of this petitioner stands in same footing as that of Munna Choudhary and Ramesh Choudhary who have
Patna High Court Cr.Misc. No.41623 of 2015 (2) dt.09-10-2015 already been granted bail in Cr. Misc. No.32558 of 2015 and 36252 of 2015.
Perused the order of the High Court granting anticipatory bail to both the co-accused persons. The case of the petitioner stands on same footing.
Considering the above facts, I direct the petitioner named above to surrender before the court below within six weeks from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram in connection with Sasaram(Muffasil) P.S. Case No.821 of 2014 subject to condition under Section 438(2) Cr.P.C.. (Mungeshwar Sahoo, J) Saurabh/- U T
