JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 420 and 406 of the Indian Penal Code and section 138 of the N.I. Act.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that though allegation is that he has given a cheque of Rs.1,70,000/- to the informant but as a matter of fact petitioner has no friendship with the informant. Further, there is no brick-kiln business of the petitioner as alleged in the F.I.R. It has also been submitted that as a matter of fact same cheque book of the petitioner has been lost in the market and for that he had informed in the bank and taking advantage of that the present case has been lodged by the
Patna High Court Cr.Misc. No.36586 of 2016 (6) dt.17-01-2017 2/2 informant when there is no allegation against him. Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail and submitted that the submission advanced by the petitioner is not probable. Having heard both sides, in view of the fact stated above, I am not inclined to grant anticipatory bail to the petitioner, same is rejected. Petitioner may surrender in the court below, i.e. C.J.M., Jehanabad , in connection with Jehanabad P.S. Case no. 91 of 2016 and make prayer for regular bail which shall be considered on its own merit without being prejudiced by the order of this Court.
This application is dismissed.
