JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-03-2018 The petitioner was granted bail by order dated 13.05.2015, passed by a Bench of this Court in Cr. Misc. No. 11556 of 2015, but subject to the conditions that his bailor would be a close relative; he shall not indulge in similar or in any other offence; he will be well represented in the Court and that in case of absence for two consecutive dates or in violation of the terms of the bail, the bail bonds will be liable to be cancelled by the Court concerned.
Learned counsel for the petitioner submits that for earning his livelihood, the petitioner has gone to a different State and he finds it very difficult to come to the
Patna High Court Cr.Misc. No.15333 of 2018 (2) dt.21-03-2018 2/2 Court concerned on all dates.
Under such circumstances, he prays for modification of the order dated 13.05.2015, to the extent that he may not be insisted upon for appearing on all the dates.
Considering the aforesaid circumstances and also taking into account that ever since the petitioner has been released on bail, he has been appearing before the Court concerned regularly, the order dated 13.05.2015 is modified to the extent that the petitioner shall be well represented in the Court and shall take prior permission of the Court for not appearing on particular dates. He shall, in that event, give an undertaking that he shall have no objection to the evidence being recorded in his absence. The order dated 13.05.2015 is modified to the extent indicated above.
The application stands allowed.
