ANJANA MISHRA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Mansi P.S. Case No.276 of 2017 for allegedly having committed the offences under Sections 302, 201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the alleged occurrence is said to have taken place after a lapse of eight-nine years of the marriage and the present case has been lodged as an afterthought by the informant only to harass the petitioners. It is submitted that the entire family has been roped
Patna High Court Cr.Misc. No.16346 of 2018 (2) dt.06-04-2018 2/2 in maliciously and the FIR has been lodged after a delay of 20 days, even though no plausible explanation has been offered for the same. Learned counsel for the petitioner further submits that no specific role has been attributed to the present petitioners. Having learned counsel for the petitioners and the learned counsel for the State, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No.276 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
