26-07-2016 Heard Sri Sanjiv Ranjan, learned counsel, who was assisted by Sri Ravi Kumar, learned counsel for the petitioner and Sri Harendra Prasad, learned Addl. Public Prosecutor. The sole petitioner, who is named as one of the accused apprehending his arrest in Vaishali P.S. Case No. 317 of 2014 registered for the offence under Sections 302/34 of the Indian Penal Code, has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that ofcourse, the petitioner was named as accused in the F.I.R., but there is no specific accusation against him regarding any overt act. On aforesaid ground, a prayer has been made for grant of anticipatory bail.
Keeping in view the fact that petitioner is one of the
Patna High Court Cr.Misc. No.28339 of 2016 (2) dt.26-07-2016 2/2 named accused in the occurrence of commission of offence under Section 302 of the I.P.C., the Court is not inclined to grant anticipatory bail.
The petition stands dismissed.
