The petitioner apprehends his arrest in Maharajganj P.S. Case No. 171 of 2016, registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code. Shiv Kumari Kunwar the informant alleged that when she came to know that her son fell in love with Savita Kumari she sent her son to Surat. On 31.08.2016 Rajesh Sharma, brother of Savita Kumari, came and asked the informant for mobile number of her son Jitendra Prasad but the informant did not provide the mobile number of her son. Rajesh Sharma threatened the informant of dire consequences. The informant alleged that on the next morning the dead bodies of her son Jitendra Prasad and Savita Kumari were found in a lonely place. It is alleged that the
Patna High Court Cr.Misc. No.16169 of 2017 (3) dt.04-07-2017 2/2 petitioner and others strangulated Savita Kumari and Jitendra Prasad to death.
Learned counsel for the petitioner submits that the petitioner has no manner of concern with Savita Kumari and Jitendra Prasad but it appears that it is a case of honour killing. Savita Kumari and Jitendra Prasad were intending to marry with each other but the petitioner and family members of Savita Kumari killed both the persons.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
