JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Heard learned counsels for the petitioner and the State. The petitioner being the father of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A and 406/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the husband of the complainant has been granted bail on readiness to make payment of maintenance amount of `5,000/- and the same is being paid by the husband of the complainant. statement to that effect has been made in para 10 of the petition which reads as follows:- "That it is also humbly stated and submitted that the husband of the complainant is also paying `5,000/- per month for maintenance of the complainant in

Patna High Court Cr.Misc. No.51265 of 2015 (2) dt.04-11-2015 2/2 view of the undertaking given before the learned Sessions Judge."

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Complaint Case No. 1382 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
