The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No.189 of 2020, registered for the offences punishable under Sections 341, 323, 307, 354, 354(A), 448, 379, 504 and 34 of the Indian Penal Code. The petitioner is said to have entered into the house of the informant and started teasing the daughter of the informant. When the informant came there, the petitioner assaulted him by means of iron rod on his head.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further

No.24651 of 2022(2) dt.31-08-2022 2/2 submitted that the occurrence took place on 31.07.2020 and the FIR was lodged on 01.8.2020, but from perusal of the injury report, it appears that the injured was examined on 30.07.2020. It is further submitted that the matter has been compromised between the parties.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, Patna in connection with Athmalgola P.S. Case No.189 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
