The petitioner is apprehending his arrest in connection with Hussainganj P.S.Case No.380 of 2018, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Prosecution story is that the informant got information about death of her mother through her brother and his sisterin-law, then the informant came to her parental house and she came to know that his brother and his sister-in-law have committed murder of Bachchani Devi, petitioner is not named in the FIR but later on his name transpired in this case and the petitioner is brother-in-law of the informant and the son-in-law of the deceased.

Submission of the learned counsel for the petitioner is that except suspicion there is absolutely nothing against them

Patna High Court CR. MISC. No.23019 of 2019(4) dt.28-06-2019 2/2 and the case is of the year, 2018. FIR was lodged in December, 2018 and the petitioner is ready to abide by any condition imposed upon him.

Heard learned A.P.P. , who has submitted that the investigation is still going on.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Hussainganj P.S.Case No.380 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition that he has co-operate to the Investigating Officer in the investigation and appear as and when required; otherwise his bail bond shall be cancelled.
