JUSTICE SANJAY PRIYA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sigori (Paliganj) P.S. Case No. 38 of 2015 instituted for the offence under Sections 406, 409, 420, 465, 467 and 468 of the Indian Penal Code.
As per First Information Report lodged by the informant, an enquiry was conducted by the DCLR Paliganj, in the capacity of Nodal Officer, for procurement of paddy in Paliganj Block made by Nadahari-Kodahari PACS and it was reported that 55 revenue receipts submitted by the beneficiaries were found forged and the Circle Officer, Paliganj. without verifying about those receipts, had made enforcement order
Patna High Court Cr.Misc. No.34118 of 2017 (3) dt.22-09-2017 2/2 causing loss of crores of rupees to the Government exchequer. It further transpires that receipts were verified by this petitioner who was the PACS Chairman.
From the written report itself it appears that out of 68 rent receipts of the beneficiaries which was recommended by the petitioner, 55 rent receipts were found to be forged and the Circle Officer, Paliganj, also without enquiring the genuineness of the rent receipts, had issued order of enforcement, on account of which, government suffered monetary loss of crores of rupees as mentioned in the written report.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below in accordance with law without being prejudiced by this order.
