Patna High Court MJC No.999 of 2023 dt.21-08-2024 2/3 The present MJC/Contempt Petition is filed for noncompliance of the order dated 25.03.2022 passed in CWJC No. 2147 of 2022. Limited direction was issued to the petitioner to submit representation within a period of four weeks from 25.03.2022. Representation was submitted on 05.04.2022. Four months' time was fixed for the purpose of considering the grievance of the petitioner and it lapsed on 04.08.2022, whereas the present MJC/Contempt Petition was filed on 10.04.2023. The respondents have taken about two years to comply orders of this Court and one year and four months from the date of filing of contempt petition. They had sufficient time to file application for extension of time or seeking review of the order dated 25.03.2022 passed in CWJC No. 2147 of 2022. The same has not been resorted to.
2. Be that as it may, even after filing of present MJC/Contempt Petition on 10.04.2023 they have complied orders only on 06.08.2024. Resultantly, they have committed Contempt of Courts. Having regard to the fact that petitioner grievance has been redressed by passing suitable orders on 06.08.2024 and it is supported by show cause, we proceed to drop the proceeding of present MJC/Contempt Petition. However, cost is warranted on account of delay in complying the orders of this Court. Litigation
Patna High Court MJC No.999 of 2023 dt.21-08-2024 3/3 cost is quantified @ Rs. 5,000/-. Cost shall be paid to the petitioner within a period of eight weeks from the date of receipt of this order by the respondents.
