Sinha, learned Senior Counsel appearing on behalf of the petitioner and the learned counsel appearing on behalf of the State.

The petitioner is apprehending her arrest in connection with Hayaghat P.S. Case No.49 of 2017 for allegedly having committed the offence under Sections 419, 420, 467, 468, 471, 409 and 120B/34 of the Indian Penal Code. Learned Senior Counsel appearing on behalf of the petitioner submits that the issue with regard to the alleged element of fraud is under consideration before this Court in a writ application and even so, the F.I.R. has been lodged against her, making farfetched allegation of having furnished forged and fabricated educational certificates.

No.16550 of 2018 (2) dt.05-04-2018 2/2 Having considered the entire facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-Vth, Darbhanga, in connection with Hayaghat P.S. Case No.49 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
