2. The petitioner is apprehending arrest in connection with Bithan P.S. Case No. 33 of 2023, registered on 22.03.2023, for the offences punishable under Sections 356, 379, 411 and 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against three unknown accused persons alleging that the accused persons in connivance with each other snatched the mobile phone of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner is not named in the FIR, his name has figured in the case solely by virtue of the confessional statement of the co-accused, namely, Nitish Kumar. It is also submitted that the alleged stolen mobile phone was recovered

5. Counsel further submits that although the criminal antecedent of the petitioner is not clean, there is one criminal case pending against him, his record was clean prior to the said confessional statement. Moreover, counsel submits that the petitioner is willing to comply with all conditions that may be imposed by the Court.

6. Learned APP for the State opposes the prayer for bail.

7. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Rosera, in connection with Bithan P.S. Case No. 33 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J.) Aman Kumar/- U T
