JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and State. The petitioner apprehends his arrest in connection with Barun P.S. case no. 06 of 2018 for the offence under Sections 379, 411, 420 of the Indian Penal Code and Section 3, 4 and 5 of the Bihar Illegal Mines Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Referring to Annexure-2, learned counsel for the petitioner submits that the petitioner has valid transport Challan and as such the petitioner cannot be fastened with any criminal liability in the instant case. Considering the statements made in para 8 of the petition and Annexure-2 read with statement made in para 3 of the petition about the clean antecedent of the petitioner, the petitioner, named above, in the event of arrest or surrender before the court
Patna High Court Cr.Misc. No.14045 of 2018 (2) dt.06-04-2018 2/2 below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. case no. 6 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
