2. This is an application for grant of regular bail submitted by the petitioner in connection with RPF/SPJ P.S. Case No. 01 of 2025 registered for the offence under Section 3 RP (UP) Act.

3. According to the case of prosecution, it is alleged that on 20.02.2025, during patrolling, officials of the RPF on the basis of suspicion reached on the spot and caught hold the present applicant there. Allegedly three other accused

Patna High Court CR. MISC. No.25642 of 2025(2) dt.02-05-2025 2/3 persons, who were also present there, fled away from the spot. From the spot, one brake block, some bearing parts and petrol clips, hose pipe, bearing plate, OHE clips, iron rope and steel chairs belongs to the railway were seized from the possession of the present applicant.

4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in the present case. The seized articles were seized from the open place. Since the applicant was present there, therefore, he has falsely been implicated in this case. He further submits that though there was one previous criminal antecedent of the petitioner but he is in custody since 21.02.2025. It is prayed that he may be granted benefit of regular bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

6. Considering the submissions put forth by the counsel for the petitioner and further considering the detention period of the petitioner in this case, I am of the view that it is a case where the petitioner should be granted benefit of bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
