The petitioner seeks bail in a case registered under Sections-341, 323, 504, 506, 188, 290, 354(B)/34 of the Indian Penal Code and Section-37© of Prohibition and Excise Act, 2016.

The prosecution case, in short, is that accused persons in drunken state, entered the house of the informant with ill motive.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner is in custody since 18-01-2019. Charge sheet in this case has already been submitted. The

Except for suspicion, there is no other substantive evidence to suggest the implication of the petitioner in the present case. There is no recovery of liquor. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Bhagalpur in connection with Kahalgaon (Ghogha) P.S.
