The petitioner is apprehending his arrest in connection with Masaurhi P.S.Case No.20 of 2017 dated 26.1.2017 arising out of G.R.No.79 of 2017, registered for offences punishable under Section 395 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and later on his name transpired on the basis of confessional statement of the other co-accused persons.

Submission of the learned counsel for the petitioner is that there is no recovery, not put on T.I.P. and the other co-accused persons have already been granted bail by this Court, vide order dated 15.5.2017 passed in Cr. Misc. No.23008 of 2017. Heard learned A.P.P. also.

No.33770 of 2017 (2) dt.20-07-2017 2/2 Having heard both sides and in view of the fact that he has been named by the co-accused persons in the confessional statement and the case is under Section 395 of Cr.P.C., as such, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of four weeks and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
