JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel submits that the petitioners have been falsely implicated due to previous case lodged against the prosecution side. He further submits that there is no allegation of any overt act against the petitioners.

Counsel for the informant submits that though the petitioners did not commit any overt act, but they instigated Anil Yadav to open fire.

In my view, if the petitioners surrender before the

Patna High Court Cr.Misc. No.48709 of 2015 (2) dt.03-11-2015 2 / 2 court below (Chief Judicial Magistrate, Aurangabad) and pray for regular bail, the same would be disposed of preferably on the same day.

This application stands disposed of.
