ANJANA MISHRA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Pirpainty P.S. Case No.61 of 2018 for allegedly having committed the offence under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that the entire case is false and fabricated and the F.I.R. has been lodged after a month of the occurrence making farfetched allegation. It is further submitted that no specific role has been attached to the petitioners and the injuries, which have been noticed, do not corroborate the prosecution story.

Patna High Court CR. MISC. No.24235 of 2019(3) dt.22-05-2019 2/2 Diary in the present case was called for, which has since been received.

Learned counsel appearing on behalf of the State after perusal of the case diary submits that the petitioner was initially treated at Jawaharlal Nehru Medical College, Bhagalpur itself and thereafter took treatment at Siliguri and Patna, which appears to be farfetched.

Considering the aforementioned facts and circumstances and there being a history of dispute between the parties and the petitioners are having no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XI, Bhagalpur, in connection with Pirpainty P.S. Case No.61 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
