1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of regular bail, arises out of Nalanda Police Station Case No. 30 of 2022, dated 21.02.2022, disclosing offences under Sections 341/323/325/307/354/34 of the Indian Penal Code.

3. The prosecution case, on the basis of First Information Report, is that the petitioner assaulted the wife of the informant on her head by means of iron rod and also on her back by means of spade due to which she sustained injury.

4. Learned counsel for the petitioner submits that there is admitted land dispute between the informant and the petitioner and the petitioner is own brother of the informant and brother-in-law of the victim. He next

Patna High Court CR. MISC. No.27205 of 2024(3) dt.26-07-2024 2/2 submits that the anticipatory bail application of the petitioner was rejected earlier by this Court in Cr. Misc. 2675 of 2023, dated 12.07.2023. The petitioner is in custody since 11.12.2023 and there is no likelihood that the petitioner will abscond and/or temper with the evidence.

Regards being had to the submissions made by learned counsel for the parties and taking into consideration the that there is land dispute between the parties, informant is full brother of the petitioner and the petitioner is in custody since 11.12.2023, I am inclined to grant regular bail to the petitioner.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned 7th Additional District Judge, Nalanda at Biharsharif, in connection with Session Tr. No. 70 of 2024 arising out of Nalanda Police Station Case No. 30 of 2022.
