====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-09-2022 Heard learned counsel for the parties.

The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 354(B), 379, 504, 506/34 of the Indian Penal Code.

As per the prosecution case, on 21.11.2021 at about 5:30 AM, petitioner no. 1 attempted to outrage the modesty of informant, while she was going to attend the call of nature. Petitioner no. 2 is alleged to have snatched silver hasuli from the neck of informant, whereas, petitioners no. 3 & 4 disrobed her. It is submitted on behalf of petitioners that petitioners

Patna High Court CR. MISC. No.24865 of 2022(2) dt.12-09-2022 2/2 have been falsely implicated in this case and present case is counter blast of Saharghat P.S. Case No. 154 of 2021 and only with a view to put pressure on petitioners, present case has been lodged. Petitioners have clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Benipatti, Madhubani in connection with Saharghat P.S. Case No. 156 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
