JUSTICE JYOTI SARAN ORAL ORDER 01-03-2016 In the nature of the order impugned at Annexure-1, I am not persuaded to interfere with the same for any interference therewith would be affecting the working of the Society. Insofar as issue of handing over charge is concerned, the petitioner shall be at liberty to question the same before an appropriate forum. The judgments relied upon by Mr. Deepak Kumar is wholly misplaced in view of the settled legal position

Patna High Court CWJC No.16480 of 2015 (4) dt.01-03-2016 that no writ lies against a Cooperative Society. The special Bench Judgment of this Court reported in 2014(1) PLJR 695 (The Organizer, Dehri C.D. & C.M. Union Ltd. vs. State of Bihar) is conclusive on the issue.

No cause for indulgence is made out. The writ petition is dismissed.
