The sole petitioner apprehending his arrest in Hajipur Town P.S. Case No. 118 of 2016 registered for the offence under Section 414 of the Indian Penal Code, Section 25 (1-B) A , 26, 35 of the Arms Act , Section 20/22 of the Narcotic Drugs And Psychotropic Substances Act has prayed for grant of anticipatory bail.
It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated. He submits that his name has come on disclosure made by the accused who was apprehended by the Police and from whose possession loaded
Patna High Court Cr.Misc. No.30310 of 2016 (3) dt.08-11-2016 2/2 pistol along with five kilograms of Ganja was recovered. He further submits that it appears that petitioner was earlier made accused in Hajipur Town P.S. Case No. 517 of 2014 however parentage in the said case is different.
Learned Additional Public Prosecutor submits that it is a case under the Narcotic Drugs And Psychotropic Substance Act and from paragraph no. 3 of the petition it is evident that petitioner is accused in other case also.
Keeping in view the nature of accusation I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
