This application, for grant of anticipatory bail, arises out of Parihar Town Police Station Case No. 110 of 2018, disclosing offences under Sections 147, 149, 341, 323, 324, 307, 379, 354, 504 and 506 of the Indian Penal Code. Members of the same family, 12 in number, have been named in the First Information Report. It is evident from the First Information Report that the occurrence had taken place in
Patna High Court CR. MISC. No.23446 of 2019(2) dt.11-04-2019 2/3 the background of some family dispute.
Learned Counsel appearing on behalf of the petitioners has submitted that in almost similar circumstance, other co-accused persons have been granted anticipatory bail by this Court by order, dated 09.01.2019, passed in Criminal Misc. No. 74275 of 2018. He also submits that there is allegation against petitioner no. 7 of making assault with sharp-edged weapon in the head of the wife of the informant, there is no injury report to suggest that any grievous injury has been caused.
Considering the above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Parihar Town Police Station Case No. 110 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their
