The petitioner seeks bail in Shivsagar P.S. Case No. 186 of 2020, registered for the offence punishable under Sections 302, 201, 120B/34 of the Indian Penal Code. As per the FIR, this petitioner along with other FIR named accused persons after hatching up criminal conspiracy killed the son of informant and threw his dead body on the railway track.
It is submitted on behalf of the petitioner that informant is not the eye-witness of the occurrence. Petitioner has been made accused in this case merely on suspicion. As a matter of fact, deceased was engaged in business of taking money from customers and lending it in the market and due to
Patna High Court CR. MISC. No.35849 of 2021(3) dt.17-01-2022 2/2 money dispute, he committed suicide. The police after investigation submitted chargesheet under Section 306 IPC. Petitioner is in custody since 21.12.2020.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Shivsagar P.S.
