The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Masaurhi P.S. Case no. 846 of 2022 instituted for the offence under Sections 302 and 34 of the Indian Penal Code. As per allegation in the FIR, informant's son namely, Mukesh Kumar went to his agricultural land for irrigating his cultivated land but did not return. During search, it was found that his son was lying dead under the bridge in a water canal. Some unknown persons have committed murder of his son and thereafter with a view to wipe off the evidence, his dead body was thrown under the bridge.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.26249 of 2024(4) dt.19-07-2024 2/3 has submitted that petitioner is innocent and has committed no offence. It is further submitted by learned counsel for the petitioner that petitioner is not named in FIR rather his name came into light in this case on the basis of confessional statement of co-accused Bikash Kumar who has already been granted bail by the Court below itself. No one is the eye witness of the alleged occurrence. During investigation, no any consistent material come against the petitioner except confessional statement of co-accused Bikash Kumar. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Other co-accused person has already been granted regular bail by this Court vide order dated 15.01.2024 in Cr. Misc. No. 70297 of 2023.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Masaurhi P.S. Case no. 846 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
