The petitioner apprehends his arrest in Pauthu P.S. case No. 13 of 2017 for the offences punishable under Section 379/411 of the Indian Penal Code and under Rule 40 of the Bihar Minor Mineral Concession Rule, 1972.
The learned counsel for the petitioner submits that driver of the tractor was carrying sand on a valid permit. The petitioner is owner of the tractor. The petitioner has got valid papers with regard to tractor and trailor.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/
Patna High Court Cr.Misc. No.34425 of 2017 (2) dt.11-08-2017 2/2 production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Aurangabad in connection with Pauthu P.S. case No.13 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
