JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-08-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 09.07.2020, within four weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
The petitioner seeks bail in connection with Rajgir P.S. Case No. 34 of 2020, registered under Sections 30(a)(b), 37(b)(c) of the Bihar Excise Prohibition Act. The accusation is that on receiving secret information about preparing liquor by Bihari Chaudhary with

No.22068 of 2020(2) dt.19-08-2020 2/3 the help of Ramdeo Chaudhary, Ajeet Chaudhary, Karu Chaudhary and Sharvan Yadav at his house, the informant and other Police personnel proceeded for there. On seeing the Police Personnel, some persons started fleeing out of them one person was apprehended, who disclosed his name Bihari Chaudhary. On search of house of Bihari Chaudhary, 266.9 liter country made liquor recovered. The apprehended person, namely, Bihari Chaudhary disclosed the name of Ramdeo Chaudhary, Ajeet Chaudhary, Pradeep Chaudhary (Petitioner) Shrawan Chaudhary and Karu Chaudhary, who succeeded to flee away.
Learned counsel appearing for the petitioner submits that petitioner was not apprehended on the spot, rather, his name has been disclosed by co-accused Bihari Chaudhary from whose house the alleged country made liquor is said be be recovered. The petitioner has no criminal antecedent and he is in custody since 24.02.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-III-
