ANJANA MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Barsoi P.S. Case No.86 of 2016 for allegedly having committed the offence under Sections 147, 148, 149, 188, 341, 323, 325, 307, 332, 333, 353, 427, 337, 338, 379 and 120B of the Indian Penal Code.

Learned counsel for the petitioners submits that the names of the petitioners have been brought in only because there is an election dispute as petitioner no.1 was a former Mukhiya of the Panchayat, where the present Mukhiya is none

Patna High Court Cr.Misc. No.32837 of 2016 (2) dt.15-09-2016 2/2 other than his wife. It is submitted that on account of such animosity and political reasons, there was some tussle at the Panchayat election and now the petitioners have been named as the accused persons. Learned counsel for the petitioners further submits that these petitioners have nothing to do with the occurrence and they have been named as part of the crowd which has gathered there. There is no specific allegation against the present petitioners.

Having heard learned counsel for the petitioners and the learned counsel for the State, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Barsoi P.S. Case No.86 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
