2. The petitioner has preferred this application for grant of regular bail in connection with Shikarpur P.S. Case No. 233 of 2023 dated 28.03.2023 registered for the offences punishable u/ss 406, 409, 420, 467, 468 and 471 of the Indian Penal Code.

3. As per the prosecution case, when the petitioner was elected as a ward member of his Panchayat, he withdrew Rs. 20,00000/- from account for compilation of Nal-Jal and Gali Nali Yojna. After withdrawing the account, the petitioner has completed work of Rs. 11,23,212 /- and Rs. 8,76,788/- was misappropriated by him. It is further alleged that after laps of

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner has completed the work on his part. Learned counsel has further submitted that the ward secretary Mukesh Kumar who is also executing the part of works, had withdrawn Rs. 6,95,000/- from bank and has not completed the work so the allegation of default of money is against the ward sachiv Mukesh Kumar. Learned counsel has further submitted that the petitioner has not misappropriated the money of the said yojna. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.11.2024.

Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the allegation of defalcation of Rs. 8,76,788/- of Government Scheme i.e. Jal-Nal and Gali Nali Yojna have been levelled against the petitioner. As per para nos. 10, 15 and 16 of the case diary, the witnesses have also supported the prosecution case.

6. Considering the aforesaid facts and circumstances of the case as well as the seriousness of allegation against the petitioner, I am not inclined to enlarge the petitioner above-

7. Learned trial court is directed to expedite the trial and conclude the same within the period of nine months.
