Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Saraiya P.S. Case No. 621/2018, G.R. No. 2116 of 2018, instituted for offences under Section(s) 272, 273, 414 and 420/34 of the Indian Penal Code read with Sections 30(a), 36, 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that during patrolling duty police party saw a Honda Car near Ayma Chura Mill at

Patna High Court CR. MISC. No.24378 of 2019(2) dt.16-04-2019 2/2 N.H. 722. Two persons were found sitting in the vehicle. They disclosed their name as petitioners. The police made search of the vehicle and recovered 374.685 litres of foreign liquor from the aforesaid vehicle.

Learned counsel for the petitioners has submitted that aforesaid liquor belonged to one Sandip. The petitioners have been arrested merely on suspicion being driver and helper of vehicle.

Petitioners are in custody since 28.12.2018 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Muzaffarpur, in connection with Saraiya P.S. Case No. 621/2018, G.R. No. 2116 of 2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
