The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on complaint of the beneficiary, the P.D.S. shop of the petitioner was raided and during inspection shortage of 150 quintals and 17 kg. of foodgrains was found.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is next submitted that the F.I.R. does not disclose the name of the beneficiary, who complained against the petitioner. It is next

Patna High Court CR. MISC. No.24471 of 2022(3) dt.14-11-2022 2/2 submitted that the P.D.S. license of the petitioner also stands suspended and the petitioner has already suffered. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Amnour P. S. Case No.15 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
