The petitioners seek pre-arrest bail in connection with Sugauli P.S. Case No. 225 of 2015 registered for the offences punishable under Sections 147, 323, 324, 380, 394, 494 of the Indian Penal Code.
On behalf of the petitioners it is submitted that the petitioners have been falsely implicated in this case, they have got no connection with the family affair of the complainant/informant or her husband Sonu Kumar, the main allegation is against the Sonu Kumar and Chandani Devi and not against the petitioners, there is case and counter case. There is no specific allegation and
Patna High Court Cr.Misc. No.33508 of 2016 (2) dt.20-08-2016 2/2 allegation of theft appears superadition and as such the petitioners deserve sympathetic consideration.
Learned A.P.P. opposes the prayer of pre-arrest bail. In the facts and circumstances stated above, considering that the petitioner no.1 Uma Devi has filed Complaint Case No. 1585 of 2015 also, no injury has been caused to the informant and further the occurrence is of 01.05.2015 and complaint case was filed on 23.05.2015 after much delay and as such the petitioners Uma Devi and Sukai Ram in case of their arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in Sugauli P.S. Case No. 225 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
