The petitioner apprehends his arrest in Complaint Case No.1787(c) of 2009 registered under Sections 420, 424, 407, 409, 450, 463, 470, 467, 468, 471 and 120(B) of the Indian Penal Code. The learned counsel for the petitioner submits that the complainant has not whispered a single word that the petitioner ever received any money in order to get a piece of land of Marachiya Devi transferred in his name. The father of the petitioner is said to have received Rs.2 lacs and after his death, the complainant came to the house of the petitioner and asked him to get the sale deed executed but the petitioner expressed his
Patna High Court Cr.Misc. No.18092 of 2018 (2) dt.09-04-2018 inability. No offence either any of the Sections of the Indian Penal Code is made out against the petitioner.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Sangeeta Rani, learned Sub Judge XIV-cum-ACJM, Patna in connection with Complaint Case No.1787(c) of 2009, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
