JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 The present application has been filed for modification of the order dated 31.05.2016 passed in Cr. Misc. No. 24459 of 2016 to the extent that father's name of petitioner No. 1 Bholeshwar Yadav has been recorded as Sipat Yadav instead of Bipat Yadav and further for extending the period of surrender. The said mistake perpetuated in the order dated 31.05.2016, since it was wrongly mentioned in the main petition.

Learned counsel for the petitioner is permitted to make correction in the main petition. It is further submitted that the said mistake was also there in the Vakalatnama. Hence, learned counsel for the petitioner has filed a fresh Vakalatname describing the father's name of petitioner No. 1 Bholeshwar Yadav as Bipat Yadav. Let the Vakalatname be kept on the record.

No.35450 of 2016 (3) dt.07-09-2016 2/2 The order dated 31.05.2016 is modified to the extent that the name of father of petitioner No. 1 Bholeshwar Yadav be read as Bipat Yadav instead of Sipat Yadav. The period of surrender is extended further by three weeks from the date of receipt/production of the copy of this order.

Accordingly the modification application is disposed of in connection with Complaint Case No. 4031C of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, IInd, Saharsa.
