The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341/323/ 504/354/506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present First Information Report has been lodged after delay of four days for which no plausible explanation has been given by the informant. It is further submitted that the petitioner and the informant had inimical terms and, therefore, the present false and malicious prosecution case been lodged.
Considering the nature of allegations made against the petitioner and also the fact that the petitioner has no criminal
Patna High Court Cr.Misc. No.50354 of 2015 (3) dt.18-01-2016 P2/2 antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Kaimur (Bhabhua) in connection with Ramgarh (Nuaon) P.S. Case No. 218 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
