JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-08-2018 It appears from the office note that in the order dated 30.3.2010 the case number was wrongly typed as C.W.J.C. No. 1545 of 2009 instead of C.W.J.C. No. 7545 of 2009. The same may be read as C.W.J.C. No. 7545 of 2009. The instant case was filed for a direction to the respondents to treat the age of superannuation of the petitioner as 65 years as the petitioner was working as Reader in Urdu in R.N. College Pandaul, Madhubani and in terms of UGC recommendation, the age of superannuation of the teachers was enhanced from 62 to 65 years.
The issue was finally adjudicated by the Apex Court
Patna High Court CWJC No.7545 of 2009(3) dt.21-08-2018 2/2 in the case of Jagdish Prasad Sharma vs. State of Bihar, (2013(8 SCC 633.
In view of the above, the writ petition is allowed. The respondents are hereby directed to treat the age of superannuation of the petitioner as 65 years and grant all consequential benefits.
Necessary decision as to the consequential relief may be taken by the respondents within a period of four months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
