2. The petitioner seeks regular bail in connection with Sandesh P.S. Case No. 28 of 2023 for the offences punishable under Sections 406, 420, 504 and 506/34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the informant had transferred a sum of Rs.25 lac into the account of the petitioner and other accused persons on different dates, out of which Rs.7 lac was deposited into the account of the petitioner. On the said basis, the case of forgery has been lodged against the petitioner and other accused persons including coaccused, Bimla Devi, who is the wife of the petitioner.

Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and knowingly the informant has transferred the amount into the account of the petitioner and other accused persons only to implicate them in a false case though he was aware of the fact that the wife of the petitioner, namely, Bimla Devi is the owner of the land, in question, for which the informant and Bimla Devi has already undergone an agreement on 06.02.2021, which bears the signature of the petitioner as a witness. Petitioner is in custody since 11.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that the dispute is purely civil in nature, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Bhojpur at Arrah in connection with Sandesh P.S.Case No.28 of 2023 , subject to the following conditions:- (1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
Patna High Court CR. MISC. No.27299 of 2025(4) dt.06-08-2025 3/3 (2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court concerned.
(3) If the petitioner tampers with the evidence or the witnesses of the case, the prosecution will be at liberty to move for cancellation of bail of the petitioner.
(4) If the petitioner is found involved in similar nature of offences, after his release on bail, the trial court shall take steps to cancel his bail bond.
(5) The district court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically loose its force. (Purnendu Singh, J) chn/- U T
