The respondent no. 5 approached the Deputy Collector Land Reforms under Land Dispute Resolution Act 2009 (for short "The Act") which gave rise to Case No. 70/108 of 2011-12. In the said case, the petitioner being father and two sons as well as purchaser of the property were impleaded as opposite party. Upon consideration of the case, the respondent-DCLR disposed of the case on 07.09.2012 (Annexure-7) whereby the Revenue Authority was directed to measure/demarcate the subject land. The present writ application is filed for implementation/enforcement of the said order.
Patna High Court CWJC No.9637 of 2014 dt.27-10-2016 2/2 Having appreciated the provision of the Act particularly Section 15 thereof, the Counsel for the petitioner seeks permission of the Court to withdraw the application so that the petitioner approaches the Forum for the relief in accordance with law. The writ application is permitted to be withdrawn with the said liberty.
