2. This application has been filed for quashing the order dated 20.06.2019 passed by the learned Chief Judicial Magistrate, Nawadah in connection with Nawadah Town P.S. Case No. 556/2012, whereby and whereunder he has taken cognizance against the petitioner for the offences punishable under sections 147, 148, 149, 307, 504, 387, 506, 337, 427 of the Indian Penal Code and 27 of the Arms Act and issue summons to the petitioner, differing with the final form submitted by the Investigating Officer and, thereafter, transferred the case to the Special Court of Additional District and Sessions Judge-III, Nawadah.

3. After some arguments, learned counsel for the petitioner prays for withdrawing this application with a liberty to raise all the grounds at the stage of framing of charge.
4. Permission is accorded.
5. Accordingly, this application is dismissed as withdrawn with the aforesaid liberty.
6. It is made clear that all the points which shall be raised by the petitioner at the stage of discharge shall be considered by the Trial Court in view of law laid down by the Hon'ble Supreme Court in the case of Kanchan Kuamr vs State of Bihar reported in (2022) 9 SCC 577.
