JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and State. The petitioner apprehends his arrest in connection with Saraiya P.S. case no. 157 of 2016 for the offence under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the F.I.R. was lodged against unknown and the name of the petitioner surfaced during course of investigation in the confessional statement of Arvind Sahani, who was apprehended in this case. Learned counsel for the petitioner submits that the petitioner has political rivalry with Arvind Sahani and bitterness between them developed during Mukhiya election.

In view of the above, the petitioner, named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing

Patna High Court Cr.Misc. No.14426 of 2018 (2) dt.06-04-2018 2/2 bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Muzaffarpur in connection with Saraiya P.S. case no. 157 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further condition that the bailors should be his family members.
