That this is an application for issuance of writ, order or direction particularly in the nature of Mandamus, directing the respondent authorities, specially respondent no. 5, the Circle Officer, Sikta, District- West Champaran to remove the encroachment from the land appertaining to Mauza- Puraina, Thana No. 293. Khata No. 735. Khesra No. 3403 & 3405, area 2 katha over which the construction under

Patna High Court CWJC No.6548 of 2024(2) dt.01-07-2024 2/3 Pradhan Mantri Awas Yojna is going on, against which, the petitioner & other villager namely Mahendra Chaudhary raised objection before the Sub-Divisional Public Grievance Redressal Officer, Narkatiaganj vide Complaint Case No.

501110107122104882 and petitioner also filed complaint case no.

9999901011221221273675 and after hearing the parties, the S.D.O., Narkatiaganj has passed the order dated 03.02.2022 & 18.02.2022 respectively directing the Circle Officer, Sikta to resolve the dispute and in compliance the Circle Officer, Sikta has issued notice against the petitioner and other villagers vide notice dated 28.11.2023 and thereafter the matter is still pending. So the petitioner prays before this Hon'ble Court to pass appropriate writ, order or direction to the concerned respondent authorities to resolve the dispute within stipulated time."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Sikta, District-West Champaran, for redressal of his aforesaid grievances. Liberty, so sought, is granted.
